Where a tenant's undertaking as to damages is inadequate to support an interlocutory injunction restraining a landlord's re-entry, the court may nonetheless grant the injunction on conditions requiring payment of all arrears and ongoing rent without deduction, with the landlord undertaking to repay any amounts later found to have been properly deducted. The suspension of rent under a damage clause (cl 8.1.1) requires the premises to remain unfit for the permitted use; once repairs are completed, the right to suspend ceases.
