Where an employer has established a safe system of work (evidenced by written procedures and consistent past compliance) and the reason for a single departure from that system is unknown, the prosecution has not established beyond reasonable doubt that the employer failed so far as was practicable to make arrangements for ensuring employee safety. The existence of a Worksafe instruction and evidence of consistent prior use of safety measures gives rise to a reasonable inference that adequate arrangements were in place, and a single unexplained failure does not displace that inference.
