Acts of dishonesty by a senior employee in expense claims, even if individually minor, fall within the rule (not the exception) that dishonesty destructive of mutual trust authorises summary dismissal, particularly where the employee occupies a position requiring an impeccable example. An oral salary sacrifice arrangement constitutes a deduction authorised by the contract of employment under s 17D(1)(b) of the Minimum Conditions of Employment Act 1993 (WA), which unlike s 17D(1)(a) does not require written authorisation, and the Industrial Relations Commission has jurisdiction to resolve set-off claims arising from such arrangements as industrial matters.
