A director found guilty under s 55(1) of the Occupational Safety and Health Act 1984 (WA) of the same offence as the body corporate employer under s 19(7) is exposed to the penalty in s 19(7) (maximum $200,000), not the general penalty in s 54(b) (maximum $25,000). The director is equated with the body corporate and its status as employer for penalty purposes. On causation under s 19(7), it is not necessary to identify a single or principal cause of death; the common sense test applies.
