The dominant purpose of firearms licence disqualification under s 106 of the Sentencing Act 1995 (WA) is public safety, broadly understood to include unfitness demonstrated by disregard of legal obligations relevant to firearms use or possession. The decisive consideration in determining the period of disqualification is generally whether the conviction and its circumstances, viewed in light of the offender's prior record, reveal that the offender is not a fit person to hold the licence. A 10-year disqualification for repeated misrepresentations on licence applications, without any unsafe use of firearms or use in commission of crime, was manifestly excessive.
