Section 13 of the Electoral Distribution Act 1947 (WA) is a binding manner and form provision that applies to Bills that would repeal the Act, not merely Bills that would amend it in the narrow sense. A Bill to repeal an Act containing a manner and form provision, where the repeal is part of a scheme to re-enact the provisions with amendments, is a Bill 'to amend' the Act. Courts have jurisdiction to declare whether it is lawful to present a Bill for Royal Assent where a manner and form provision is in issue. Wheeler J's dissent, holding that 'amend' should be construed strictly and does not encompass complete repeal, was not adopted by the majority.
