A debtor served with a statutory demand by an assignee who has not been given access to the documents on which the claim depends may satisfy the jurisdictional requirement of s 459G(3)(a) by deposing to a genuine belief that the assignment may be void, without setting out all material facts necessary to establish invalidity. Non-compliance with the procedural requirements of the Corporations Rules (such as annexing a company search) is not fatal to the application where the statutory jurisdictional requirement is met, as the rules are subject to the court's general dispensing power.
