The discretion to review a single judge's decision in the Court of Appeal must be exercised in accordance with the overriding purpose of the Supreme Court Rules (Pt 1 r 3). The Court will decline to exercise that discretion where the substantive proceedings are at an interlocutory stage and the matters can be dealt with by the judges hearing the substantive application. No appeal lies from an interlocutory evidentiary ruling made in the course of a recusal application.
