The prima facie right of a plaintiff to insist upon the exercise of jurisdiction it has invoked does not apply to temporary stay applications. The relevant considerations include which proceedings were commenced first, the potential impact of one set of proceedings on the other, the undesirability of duplicative proceedings, the progress of each set of proceedings, and the conduct of the parties. A court granting or refusing a temporary stay must expose its reasoning sufficiently to avoid leaving the losing party with a justifiable sense of grievance.
