A transverse bar at shin height across a footpath, left exposed by vandal removal of a glass panel from a bus shelter, constitutes a trap for pedestrians rather than an obvious hazard that pedestrians should be expected to perceive and avoid. Such a hazard is qualitatively different from ordinary road surface imperfections (uneven paving, stones, holes) discussed in Brodie v Singleton Shire Council. A road authority notified of such a hazard and failing to act within a reasonable time will be liable in negligence.
