The output test is the appropriate measure of intensification of quarry use under s 109(2)(c) of the Environmental Planning and Assessment Act 1979 (NSW). Replacing machinery with more efficient equipment that produces the same product at the same or lower output does not constitute intensification. Crushing and screening of quarried material is ancillary to the winning of extractive material and does not constitute a separate use. The concepts of intensification and character of continued use are distinct and must not be elided.
