Section 151K of the Workers Compensation Act 1987 (NSW) applies to limit the rate of compensation for future domestic care services to the statutory rate; the words 'are to be provided' do not restrict the section to cases where there is an existing obligation to provide future care. The exception in s 151K(1)(b) for amounts paid or liable to be paid cannot apply to future care unless the worker proves an existing contractual liability to pay greater amounts. When assessing domestic assistance, account must be taken of contributions that can be expected from family members as part of the ordinary and fair give and take of family life.
