A notice initiating a tiered dispute resolution process under a contractual clause need not be drawn with the formality of a pleading; it must capture or describe the essence of the dispute from the initiating party's perspective and is to be construed fairly in its context. A single notice may encompass multiple disputes or differences. A party challenging the validity of such a notice must challenge it in its entirety or identify severable parts; if the notice validly enlivens the process for at least some disputes, a declaration of total invalidity will not be granted.
