The two recognised exceptions to the costs-follow-the-event rule in contested probate proceedings — (1) the testator caused the litigation, and (2) the circumstances led reasonably to an investigation — overlap but remain conceptually distinct. A finding that circumstances warranted investigation does not compel a finding that the testator caused the litigation. A party who fails to raise the 'testator caused the litigation' argument at first instance cannot raise it on appeal.
