An expert cyclist's failure to perfectly execute a difficult evasive manoeuvre in a split-second emergency does not constitute contributory negligence, even though her expertise may allow her to gauge risks with greater precision. The agony of the moment doctrine applies equally to highly skilled persons. An appellate court will not disturb a trial judge's discretionary assessment of damages within a range of legitimate difference absent identified appellable error.
