A motorboat operator in a navigational channel owes a duty to keep a proper lookout for swimmers, even where swimming is prohibited, if the presence of swimmers is foreseeable. A snorkeller swimming face down in a busy navigational channel with knowledge of boat traffic bears substantial responsibility for their own safety, warranting a 40% reduction for contributory negligence. Breach of a regulatory prohibition (such as a fishing ban) cannot independently ground contributory negligence unless the prohibition has a causal connection to the type of harm suffered.
