In applications for a stay of professional disciplinary decisions pending appeal, the public interest in the protection of the public and the maintenance of the reputation of the profession is entitled to significant, and potentially determinative, weight. The stay application cannot be treated as ordinary private litigation, and concepts such as 'balance of convenience' and 'preserving the status quo' are inapt. Where strike-off proceedings with substantial prospects of success are on foot, the Court should be very slow to permit the practitioner to continue in practice pending determination.
