Under s 155 of the Crimes (Administration of Sentences) Act 1999, an applicant must establish not merely that false, misleading or irrelevant information was before the Parole Board, but that the Board's decision was 'made on the basis of' that information. The section confers no jurisdiction to review the Board's reasoning process or conclusions. In the absence of evidence contradicting the information before the Board, the Court will not ordinarily be able to find information was false or misleading. The scope of directions available under s 155(2) remains unresolved.
