A misstatement of the maximum penalty for an offence taken into account on a Form 1 does not vitiate the sentence where the error did not enter into the reasoning process by which the sentencing judge arrived at the sentence. The utilitarian value of a guilty plea in saving the cost and time of a trial remains a matter to be taken into account even after the High Court's decision in Cameron v The Queen, as held in R v Sharma.
