The R v Henry guideline judgment for armed robbery, while not directly applicable to the offence of assault with intent to rob whilst armed under s 97(1) of the Crimes Act 1900 (NSW), may properly be used as guidance by sentencing judges. A motive of obtaining money to buy food does not materially diminish criminality, as many offences are committed by offenders who reasonably consider themselves in serious need of money.
