The loss of the chance of summary disposal in the Local Court is a matter to be taken into account in sentencing but is not a universal factor for reduction; a sentencing judge need not expressly mention it in remarks on sentence where the topic was raised and acknowledged in debate. Judicial Commission sentencing statistics must be approached with caution and do not demonstrate manifest excess where the offender's profile may differ from the statistical base. A sentencing judge may impose a longer sentence than might otherwise be warranted where shorter sentences have repeatedly failed and a substantial parole period is needed for rehabilitation.
