A guilty plea entered on the morning of trial, without other evidence of contrition, does not permit an inference that contrition inspired the plea. Judicial Commission sentencing statistics provide a check but should not govern the sentencing process; the proper approach is to consider the sentence in light of the statutory provision and established sentencing principles. Motivation of loyalty to associates does not significantly mitigate an offence under s 315 of the Crimes Act 1900 (NSW), as such motivation is part of the evil against which the section is directed.
