In sentencing for supply of a commercial quantity of heroin, the maximum penalty for the next lower quantity threshold (indictable quantity, 15 years) may be used as a starting point where the quantity exceeds that threshold. A subordinate role in a drug supply operation warrants a reduction of approximately one-third. Voluntary resumption of drug use after a period of being drug-free provides no basis for reducing sentence on account of addiction. Rehabilitation prospects should be reflected more in the non-parole period than the head sentence. The Court expressed a preference for structured reasoning over instinctive synthesis in sentencing.
