On an application to set aside a statutory demand based on an offsetting claim, the evidence need not establish the facts constituting the claim but must demonstrate a genuine claim warranting subsequent adjudication; something beyond mere assertion is required but precision is not demanded. Where the affidavit filed within the 21-day period sufficiently raises the factual basis of the claim, a later affidavit may supplement it. An entire agreement clause cannot preclude a Trade Practices Act remedy based on pre-contractual misleading representations.
