Where there is no contractual relationship between a student and a university, and the university's power derives solely from its establishing statute, a decision to exclude a student from candidature is a decision 'under an enactment' subject to judicial review. The absence of a contractual relationship is a critical distinguishing factor from cases like ANU v Burns and ANU v Lewins. A decision need not subtract from statutory rights to be reviewable — this is not a requirement of s 4 of the Judicial Review Act 1991 (Qld).
