A purely retrospective declaratory order (declaring rights void ab initio) cannot be stayed pending appeal, because once the declaration is made the order has done its work and the court cannot render the subject matter valid for a temporary period. The power to stay declaratory orders is confined to declarations with prospective effect. Where an applicant knowingly assumed the risk of adverse proceedings, this weighs heavily against the grant of a stay.
