A proceeding constitutes an abuse of process where the plaintiff persists with it after completion of interlocutory steps without being able to identify the material facts upon which the claim is based, such that the defendant cannot know the case to meet. A respondent to such a proceeding is not required to bring a summary dismissal application immediately but may wait until it becomes clear that the deficiencies will not be remedied.
