A sentencing judge's findings as to motive are not confined to matters expressly opened by the Crown or admitted by the offender, but may be drawn from the totality of the evidence including records of interview. In sentencing for manslaughter involving betrayal of trust and luring a victim into a violent trap, a head sentence of seven years (maximum 20 years) with a five-year non-parole period is within range even for a 19-year-old first offender who pleaded guilty, where the offence falls just short of murder.
