Transitory and fleeting use of adjacent land for parking manoeuvres, where the boundary is unmarked and the use leaves no permanent mark, may be insufficient to establish a prescriptive easement because: (1) such use is not of a character to impute knowledge to a diligent servient owner; (2) it does not indicate to a reasonable person that a right is being asserted; and (3) it is properly characterised as tacit neighbourly consent rather than user as of right. Additionally, acquiescence in an interruption (such as the parking of an obstructing vehicle) for over 12 months defeats a prescriptive claim.
