A notice under s 64(1) of the Workers' Compensation and Rehabilitation Act 1981 (WA) requiring a worker to submit to medical examination is valid if it names the medical practitioner, even if it does not specify the date and time of the appointment. A worker who attends an examination but withdraws authority for the doctor to report results to the employer has refused to submit to or obstructed the examination. The question whether s 64(1) applies where the nominated doctor has a pre-existing doctor-patient relationship with the worker was left open.
