A defendant's failure to discover relevant documents in a timely fashion may constitute material prejudice sufficient to refuse leave to amend the defence, particularly where the late discovery deprives the plaintiff of a real chance to reconsider their litigation strategy before a limitation period expires against another potential defendant. The explanation that documents were 'archived' does not satisfactorily excuse a failure to discover.
