An independent contractor on a worksite is entitled to assume that the area where the principal contractor's foreman is working is safe, absent warning to the contrary. The person with knowledge of a specific hazard bears the duty to warn, and failure to do so negates contributory negligence on the part of the person injured. Private health insurance payments cannot be credited to the tortfeasor in reduction of special damages.
