Where a magistrate's errors of law or fact have affected credibility findings central to the conviction, an appellate court cannot apply the proviso (no substantial miscarriage of justice) by making its own credibility assessment from the written record alone. The matter must be remitted for fresh factual findings by the tribunal that had the advantage of seeing and hearing the witnesses. The majority held remittal to the same magistrate was appropriate; em Heenan J would have required a different magistrate on the basis that adverse credibility findings reached on an erroneous basis cannot readily be disentangled.
