On an application for extension of time to enter an appeal for hearing, the relevant factors are the length of delay, the explanation for delay, prejudice to the respondents and the court, and whether the appeal is so obviously devoid of merit as to be futile. A delay of approximately 10 weeks over the Christmas/January period, without evidence of prejudice, will not preclude an extension.
