A wrong finding of primary fact by the Compensation Court — even one that is clearly erroneous, repeated, and materially affects the outcome — does not constitute an error of law reviewable under s 32 of the Compensation Court Act 1984 (NSW). The 'no evidence' ground available in general judicial review (per ABT v Bond) does not apply in the specific and limited statutory appeal jurisdiction under s 32. A wrong finding of fact cannot be recharacterised as a 'no evidence' question.
