In applications to extend time to rescind a deemed dismissal under District Court Rules Pt 12 r 4C, the applicant must provide an adequate explanation for the whole period of delay, not merely the period after the deemed dismissal took effect. The absence of a statutory requirement for an explanation does not relieve the applicant of this obligation.
