The Rivkin test — that a jury's finding on conveyance of imputations can only be overturned if no reasonable jury could reach it — applies equally to findings that imputations are not defamatory. An interlocutory determination striking out a separate publication pleading in defamation proceedings may be challenged as of right on appeal from the final jury verdict, without requiring leave, where the determination affected the final result by eliminating separately pleaded imputations.
