Where a plaintiff's earning capacity has been diminished by a tortious injury and is subsequently further diminished by an independent non-tortious accident, the later accident must be taken into account in assessing damages for economic loss, just as subsequent illness or death would be. The distinction drawn in Luntz between subsequent natural conditions and subsequent accidents is rejected. Where the evidence does not permit precise calculation of the overlap, a broadly assessed lump sum should be struck.
