A finding that an injury occurred in the course of employment does not of itself establish that employment was a substantial contributing factor under s 9A of the Workers' Compensation Act 1987 (NSW). The substantial contributing factor determination is a distinct question of fact and degree, not automatically resolved by the course of employment finding. Whether the worker was performing positive duties at the time of injury is a relevant but not determinative consideration.
