A Parker warning given by a tribunal, carefully qualified and made in its forensic context, satisfies procedural fairness obligations and does not constitute unfair pressure, prejudgment or bias. Consent orders made with the assistance of experienced counsel following such a warning are not vitiated by procedural unfairness. Fairness is a practical concept directed at avoiding practical injustice, and a party who has ample opportunity to respond to adverse indications but chooses not to do so cannot later complain of procedural unfairness.
