A conviction under s284 of the Migration Act 1958 (advertising immigration assistance while unregistered) is not logically inconsistent with an acquittal under s283 (falsely representing oneself as a registered agent), as the two offences have different elements. An applicant who appeals as of right to the District Court exhausts appeal rights and cannot subsequently seek judicial review in the Court of Appeal to re-agitate factual findings.
