An ankle injury causing permanent ligamentous instability, inability to work as a casino dealer, preclusion from competitive sport, and risk of post-traumatic osteoarthritis in a 24-year-old was assessed at 20% of a most extreme case under s 16 of the Civil Liability Act 2002 (NSW), yielding damages of $9,500 for non-economic loss. An assessment of 33% for such an injury was held to be manifestly excessive.
