A 20mm differential between concrete pavers on an outdoor footpath at commercial premises does not constitute a breach of the occupier's duty of care. The fact that a footpath is on private commercial premises rather than alongside a public highway does not impose a higher standard of care where the footpath is outdoors, traversed by many members of the public, and in essence no different from a public footpath.
