A site controller who directs a truck driver to reverse over lengthy distances without a spotter, in circumstances of limited rear vision and a noisy worksite, breaches its duty to maintain a safe system of work. A labour hire employer's non-delegable duty of care to its employees is not discharged merely by placing them under the supervision of a reputable host employer; the labour hire company must take affirmative steps to ensure safe working conditions. Where a plaintiff suffers psychiatric illness following a traumatic event, reactions such as anger and heightened distress are not automatically excluded as non-compensable 'ordinary grief' — they may be symptoms of the compensable psychiatric condition.
