Whether defects in an unregistered vehicle are 'minor defects' under s 33(5)(b)(ii) of the Motor Accidents Compensation Act 1999 is to be assessed by reference to the ease and cost of repair, not the significance of the defects for safe vehicle operation. Section 126(2) of the Act permits upward adjustment of future economic loss damages to account for the possibility that the claimant's circumstances would have been better than the most likely future circumstances. Respite care under s 129 is not available for the period during which professional carers provide care, as the purpose of respite care is to relieve gratuitous carers.
