Where retrospective legislation creates a cause of action by making past events sufficient for its existence, the limitation period does not begin to run until the date the legislation takes effect, not from the date of the underlying events. An insurer's letter admitting breach of duty of care, read in context as admitting liability rather than merely one ingredient of the cause of action, constitutes a confirmation under s 54 of the Limitation Act 1969. A later letter referring to earlier correspondence can republish and confirm the admissions in the earlier letters for the purposes of s 54.
