An oral agreement by which one party undertakes to sell land to a third party (not the other contracting party) is a 'contract for the sale or other disposition of land' within s 54A of the Conveyancing Act 1919 (NSW) and must be evidenced in writing. A contract partly within and partly outside s 54A is wholly unenforceable unless the promises are severable. The mere making of an oral agreement, without any additional representation that the agreement will be honoured notwithstanding the absence of writing, cannot found an equitable estoppel preventing reliance on s 54A.
