A person in charge of a motor vehicle who gives instructions for its operation remains a 'driver' within the extended definition in s 3(1) of the Motor Accidents Act 1988 (NSW) even when the vehicle moves out of control as an unintended consequence of those instructions. The compulsory third party policy responds in such circumstances under s 9, covering liability caused by the fault of that driver in the use or operation of the vehicle.
