When sentencing a child for a serious children's indictable offence under s 17 of the Children (Criminal Proceedings) Act 1987, rehabilitation remains the primary sentencing objective, and considerations of deterrence and denunciation may properly be largely discarded in favour of individualised treatment. Expert evidence from juvenile justice counsellors on the counter-productive effects of incarceration for young offenders should be given significant weight. The amended s 44 of the Crimes (Sentencing Procedure) Act 1999 (standard minimum sentencing) applies only to offences committed after 1 February 2003.
