A sentence of 2 years and 8 months imprisonment for supply of approximately 50.8 grams of cocaine at 75% purity, with a further deemed supply of 17.9 grams taken into account, was within the range of sound sentencing discretion. An applicant who elects not to give evidence cannot complain that the sentencing judge did not infer contrition from tangential material. It is not axiomatic that actual supply is always more serious than deemed supply.
